This Privacy Policy explains how Flare Web Design, LLC ("Flare," "we," "us") collects, uses, and discloses personal information when you visit https://www.flarewebdesign.com or interact with us. We focus on U.S. privacy requirements, including the California Consumer Privacy Act as amended by CPRA ("CCPA/CPRA"), Colorado/Connecticut/Virginia privacy laws, and CalOPPA. Categories of Information We Collect (CPRA/US States)
Depending on how you interact with us, we collect the following categories of personal information:
- Identifiers: name, email address, phone number, business details, IP address. Used for account requests, support, testimonials, and security.
- Customer records / commercial information: project requirements, service agreements, invoices or payment metadata processed via our billing provider. Used to provide and bill for services.
- Internet / electronic activity: usage analytics (page views, performance metrics) captured through Vercel Analytics and server logs. Used to monitor performance and detect abuse.
- Approximate geolocation: city-level location derived from your IP for the collaborative cursor feature on desktop browsers.
- Audio/visual or user-generated content: testimonials or notes you voluntarily submit, plus optional sticky notes saved locally on your device.
- Inferences / personalization data: optional name personalization, theme settings, sticky notes, and music volume stored via local or session storage on your device (not synced with our servers unless you explicitly share it).
We collect these categories directly from you (contact forms, meetings), automatically through your device/browser, and from service providers acting on our behalf (e.g., Ably for real-time cursor data, ipapi for coarse IP lookups, Cloudflare for security, Stripe or similar billing processors for payments).
How We Use and Share Information
We use the categories above for the following purposes and share them only with service providers that help us operate the site:
- Provide requested services: respond to contact requests, scope projects, deliver support, publish testimonials (with your permission).
- Billing and administration: generate proposals/invoices and process payments through our billing provider (currently Stripe or a comparable merchant of record).
- Security and network protection: detect fraud or abuse, block malicious traffic, and maintain platform reliability via Cloudflare and our hosting providers.
- Personalized experiences: remember the name, theme, sticky notes, or audio settings you save locally so pages feel tailored to you (optional and stored on your device).
- Collaborative cursor feature: show anonymous cursor presence so visitors can see live interactions. This relies on ipapi (coarse geolocation) and Ably (real-time messaging) but never stores precise location or personal identifiers.
- Analytics and performance: understand traffic patterns through Vercel Analytics to improve responsiveness and troubleshoot outages. We receive aggregated metrics, not individualized behavioral profiles.
We will ask for additional consent before using information for materially different purposes or where required by law.
Retention of Your Information
We keep personal information only as long as necessary for the purposes above:
- Inquiry and support records: up to 24 months after our last interaction unless a longer period is needed to resolve an issue.
- Contracts, invoices, and payment records: retained for 7 years to meet tax and accounting obligations.
- Server logs and security data: typically 90 days unless needed to investigate abuse.
- Analytics data: retained by Vercel in aggregated form for approximately 13 months.
- Optional personalization (name, sticky notes, theme, volume): stored locally on your device until you clear browser storage or use the controls described in our Cookie Policy.
Collaborative Cursor Feature:
Our website includes a collaborative cursor feature (desktop only) that displays anonymous cursors from other visitors currently viewing the same page. This feature:
- Uses your IP address to determine your approximate city location via a third-party geolocation service (ipapi.co)
- Stores an anonymous user ID in your browser's session storage (deleted when you close your browser)
- Transmits your cursor position and city name to other visitors on the same page via Ably's real-time messaging service
- Does not collect or store any personally identifiable information
- Only operates on devices with mice (not tablets or mobile devices)
- Cursor data is ephemeral and deleted after 5 seconds of inactivity
Your Rights:
Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. You may opt-out of direct marketing communications or the profiling we carry out for marketing purposes by writing to us at hello@flarewebdesign.com.
If you do not allow us to collect or process the required personal information or withdraw consent, you may not be able to access or use the services for which your information was sought.
